In a recent judgement pronounced by the Ontario Court, where a woman agreed to have sex with the man on the condition that they would use a condom, he penetrated without using the same and putting the woman to a danger of unwanted pregnancy.

The man and woman met through an online dating site where they agreed to have sex only on the condition that there must be a use of condom and secondly, that they would respect each others boundaries. When the man penetrated without the use of the condom it amounted as fraud upon the woman, a violation of the conditions they had agreed to. The Court held that the accused was guilty of committing sexual assault.
